When will Cuyahoga County Executive FitzGerald move to nullify MEDCON "contract"?Submitted by Jeff Buster on Tue, 10/18/2011 - 10:18.
Cuyahoga County is going to be financially drained by the MEDCON just as Harrisburg Pa has been financially drained by a “trash incinerator”.
MEDCON is a morbid PARASITE on Cuyahoga County.
When will County Executive FitzGerald take action to nullify the odious MEDCON “deal” with MMPI?
The sooner the better.
Here’s Why:
Harrisburg is bankrupt for two reasons.
1. The Harrisburg City Council was conned/ ignorantly believed that Harrisburg could own and operate a trash incinerator and make money.
2. The Harrisburg City Council entered into a multi million dollar contract to re-hab the incinerator and did not require a bid bond, performance bond, or payment bond from the contractor. At the time Harrisburg entered into the incinerator contract, they had ample warning of failure. You can read more about the Harrisburg incinerator debacle here on PennLive
The Harrisburg City Council knew there were no bid bonds for the incinerator rehab and signed the fatal contract anyway.
Cuyahoga County ex County Commissioners Hagan, Dimora, and Lawson-Jones:
1. “bought”, for almost a billion dollars over 20 years, the totally (data and statistically) unsupported/unsupportable medical equipment display and medical equipment “conference” center – with the phantasmagoric claim that the MEDCON would be an economic engine for Cuyahoga County.
2. Hagan, Dimora, and Lawson Jones very intentionally did not:
A. put the sales tax hike financing the project out for public vote as required under State of Ohio procurement law,
B. did not put the project out for public bid, instead dealing secretly and privately with Chris Kennedy and MMPI (the company Kennedy headed), a Vornado subsidiary,
C. did not obtain a bid bond, performance bond or payment bond from Chris Kennedy, MMPI, or Vornado guaranteeing the results of MEDCON.
Normally, every contract sought by any public entity requires a bid bond, performance bond, and payment bond. Read about contract surety bonds here.
Recently Dimora is alleged by the FBI to have operated a RICO enterprise from the Cuyahoga County Offices – and Dimora was the one Commissioner who had the most behind-the-scene contact with MMPI (Dimora's contact with MMPI was arranged by Hagan, so Hagan is very suspect as well), Chris Kennedy and crew, and Squire Sanders' Fred-the-Fixer Nance.
County Executive FitzGerald has the fiduciary obligation to declare the MMPI “deal” odious debt and move to nullify the Cuyahoga County MEDCON contract.
The sooner, the better for Cuyahoga citizens.

Our local politicos do not want residents to scrutinize the proposed Ridge Road incinerator, either...another disaster in the making.

The key to the deal was the TIF (Tax Increment Financing) Ordinance granted under ORC 5709.41-43 and passed by City Council under the whip of Sabra Scott Pierce, which granted a 100% property tax exemption for the Property Improvements at issue. The TIF was in turn key to the financing of revenue bonds issued by the Port Authority. The City first had to forge an agreement with the School District , which stood to miss out on a lot of tax revenue from this TIF deal. The City's agreement with CMSD said it was anticipated that the TIF Ordinance would grant the city Payments in Lieu of Taxes (PILOTs) from the Developer equivalent to the amount of taxes that the city would have received had the exemption not been granted. Is that how it turned out? Then CMSD was to receive about 32% of the PILOTs. ............ The land apparently was deeded first to the Port Authority, then transferred to Veterans Development in December 2010. The land is currently valued at $1 million, and no tax value has yet been assigned to the improvements, and the county's web site for real property info is corrupted for this combined parcel (surprise!). .............. The CMSD deal was negotiated by Dan Burns, who was not a lawyer and is currently serving prison time for a purchasing scam. The CMSD Board of Educaton also was led to believe that there would be a side deal with the developer and/or the VA for internships to be supplied by them for students. Where is that agreement? Where are the internships? ............... Another key to this whole thing would have been the valuations of the improvements by the office of Auditor Frank Russo, who had his crooked pals at VAS enterprises doing that job. Well, the valuation gig collapsed and Frank is no longer in office, so the other shoe has yet to drop on the whole TIF deal, with valuations being the key.
Meanwhile, why has the PD not dissected the TIF deal? Could be fun.

Sabra Scott Pierce ran the campaign for Mayor Jackson's reelection. The corruption probe especially as it relates to Sweeney, Jackson's brother Nick at CMSD and Sabra Scott's connection to Forlani and the mob need further investigation. Sabra Scott's husband is Randell Scott--commissioner of Cleveland streets (whatever that means). Obama admin can not let this slide.
